Terms and
Conditions

The parties agree and stipulate that the rental will be governed by the following agreements and conditions.

Article 1
Personal Data and Driving License

The customer agrees to not provide false information on their general information, age, address, and driving requirements. The customer must have a valid driving license for the rented vehicle.

Customers from countries outside the EU must present an international driving license, provided that the State of origin is a signatory of the Geneva Convention of 1949 or the Vienna Convention of 1968.

Article 2
Assignment of the Vehicle

The scooter is given to the customer with a full tank of fuel, supplied with standard equipment, accessories (helmet, anti-theft system), and circulation documents. The vehicle is delivered in excellent condition of storage and operation, without defects.

Article 3
Conditions of Use

Only the client is authorized to drive the scooter. Sub-rental of the vehicle to third parties in any form is strictly prohibited. The vehicle must not be used for commercial transport, towing, under the influence of substances, or for purposes contrary to the law.

The customer is required to use all anti-theft devices whenever the vehicle is parked and left unattended. The rates include limited mileage of 100 km per day.

Article 4
Road Code

The customer declares to be aware of the regulations of the current traffic laws, with particular reference to helmet use, speed limits, and the consequences deriving from non-compliance.

Article 5
Insurance

The rented motor vehicle is covered by civil liability insurance.

Damage Liability Limitation: Additional service at €20/day with €300 deductible. Limits financial liability in case of damage to the vehicle for causes other than theft or fire.

Theft Liability Limitation: Additional service at €20/day with €500 deductible. Limits liability in case of loss or damage as a result of theft, attempted theft or fire.

Both options shall be deemed void in the event of gross negligence by the renter (misuse, driving on rough roads, wrong fuel, failure to attend to warning lights, etc.)

Article 6
Limitations of Liability

Within the limits set by law, the lessor cannot be held responsible for any damage suffered by the client or third parties deriving from the use of the rented vehicle, or for loss or damage to property left in or on the vehicle.

Article 7
Insurance Claims

If there is a claim, the Customer agrees to: immediately inform the Lessor by telephone; inform the nearest police authority; not issue declarations of responsibility; take note of names and addresses of parties and witnesses; follow the Lessor's instructions.

Article 8
Return of the Vehicle

The Customer undertakes to return the vehicle at the agreed date and time, in the same conditions of delivery. The Customer shall be held directly responsible in case of theft and/or fire of the rented vehicle.

Article 9
Charges

The Customer will pay or reimburse the Lessor: in the event of theft or fire, the cost of the entire scooter; any fines, penalties and court costs; in case of administrative stop, the daily rate increased by 25%.

Article 10
Penalties

Loss: Keys €50 — Documents €350 — Helmet €45 — Anti-theft €25

Without full tank: €20

Failed return: After 1h = daily rate; After 1 day = +15%/day first week; From second week = +25%/day

Article 11
Jurisdiction

For any dispute, the court of competent jurisdiction is Torre Annunziata.

Article 12
Language

The Italian text will prevail in case of conflict with the text translated into other languages.

Article 13
No Refund

After the signing of the rental agreement no refund of the rental rates will be made.

Article 14
Security Deposit

A security deposit will be required, and the amount will vary depending on the type of vehicle chosen.

Personal Data Processing
